1. Definitions & Interpretation
"Seller" means Ozzy Tyres Pty Ltd and its authorised franchisees.
"Buyer" means any individual or entity purchasing goods or services from the Seller.
"Goods" means all wheels, tyres, accessories, services and related merchandise supplied by the Seller.
"Conditions" means these Terms & Conditions of Sale.
2. Acceptance of Terms
2.1. These Conditions apply to all orders placed by the Buyer.
2.2. By placing an order, the Buyer agrees to be bound by these Conditions.
2.3. These Conditions override any inconsistent terms proposed by the Buyer unless expressly agreed in writing.
2.4. Ozzy Tyres may vary these Conditions at any time.
3. Australian Consumer Law (ACL)
3.1. Nothing in these Terms excludes, restricts or modifies any rights under the Australian Consumer Law.
3.2. Customers are entitled to statutory consumer guarantees.
3.3. Remedies for faulty goods will be provided in accordance with ACL.
4. Orders & Seller Discretion
4.1. Seller reserves the right to accept or decline any order in whole or in part.
4.2. Orders are not confirmed until payment is received and stock allocated.
4.3. Seller may cancel orders due to stock errors, pricing errors, fraud concerns or technical faults.
5. Pricing & Promotions
5.1. All prices are in AUD and include GST unless stated otherwise.
5.2. Prices may change without notice.
5.3. "Up to" savings refer to maximum potential discounts on selected items only.
5.4. Promotional codes must be entered online at checkout and cannot be applied retrospectively.
5.5. Only one coupon may be redeemed per transaction unless stated otherwise.
5.6. Coupons may not be used in conjunction with other offers unless expressly stated.
5.7. Promotions may be withdrawn or amended at any time.
6. Delivery & Dispatch
6.1. Seller aims to dispatch goods within 7 business days where stock is available.
6.2. If items are not in stock, they may be placed on backorder.
6.3. Delivery timeframes are estimates only and not guaranteed.
6.4. Seller is not liable for delivery delays beyond its control.
6.5. Delivery times listed for capital cities are indicative only. Rural and remote areas may take longer.
6.6. Tracking details will be provided where applicable.
7. Shipping to Remote & Island Areas
7.1. Standard delivery pricing applies to most Australian metro areas.
7.2. Remote or island areas may require additional freight charges.
7.3. Delivery may be to the nearest depot where applicable.
7.4. If suitable delivery cannot be arranged, a full refund may be issued.
8. Passing of Risk & Title
8.1. Risk passes to Buyer upon delivery.
8.2. Seller accepts no liability for transit damage unless notified in writing within seven (7) days of delivery.
8.3. Title to goods remains with Seller until payment in full is received.
8.4. Seller may enter premises to recover unpaid goods where permitted by law.
8.5. If Buyer resells goods prior to full payment, proceeds must be held in trust for Seller.
9. Returns & Cancellations
9.1. Returns require prior written approval.
9.2. Goods returned without consent may be rejected.
9.3. All returns must be accompanied by invoice details and valid return documentation.
9.4. A 25% restocking fee applies to cancelled orders.
9.5. Buyer is responsible for all freight costs unless goods are faulty under ACL.
9.6. Wheels fitted with tyres will not be accepted for return.
9.7. Tyres mounted to wheels cannot be returned.
9.8. Wheels must be returned in original packaging.
9.9. Modified, painted or machined wheels cannot be returned.
9.10. Goods driven on cannot be refunded as new.
9.11. Returns must be lodged within 14 days of purchase.
10. Wheel Appearance & Product Representation
10.1. Images are for illustrative purposes only.
10.2. Actual product may vary in shade, PCD, bolt pattern, concave depth, dish or lip size.
10.3. Vehicles shown may include modifications not included in advertised price.
10.4. Colour display may vary by screen.
10.5. Customers should confirm final specifications before purchase.
11. Fitment Guarantee
11.1. Fitment guarantee applies to standard, non-modified vehicles only.
11.2. Custom tyre options void fitment guarantee.
11.3. Vehicle modifications must be disclosed in writing.
11.4. Failure to disclose modifications voids fitment guarantee.
11.5. Seller is not responsible for compliance with state-based vehicle modification laws.
12. Custom Drilling & Machining
12.1. Custom drilling and machining services may incur additional charges.
12.2. Once custom machining has commenced, orders are non-refundable.
12.3. Buyer accepts responsibility for confirming specifications.
13. Beadlock Steel Wheels
13.1. Beadlock lip bolts must be tightened to manufacturer torque specifications.
13.2. It is Buyer's responsibility to ensure bolts are checked regularly.
13.3. Seller is not liable for failure to maintain beadlock components.
13.4. Off-road use increases maintenance requirements.
14. Wheel Care & Maintenance
14.1. Wheels must be cleaned using mild soap and water.
14.2. Harsh chemicals void warranty.
14.3. Wheels must cool before cleaning.
14.4. Automatic car washes are not recommended.
14.5. Failure to maintain wheels may void warranty.
15. Compliance & Vehicle Modifications
15.1. Certain wheel sizes, offsets, lifts and tyre combinations may not comply with road regulations.
15.2. Buyer is responsible for ensuring compliance with state laws.
15.3. Aggressive offsets may require guard modifications.
15.4. Suspension lifts may affect insurance and registration compliance.
16. Warranty
16.1. Manufacturer warranties apply where provided.
16.2. Warranty excludes normal wear and tear.
16.3. Warranty excludes racing, track use or misuse.
16.4. Improper installation voids warranty.
17. Limitation of Liability
17.1. To the maximum extent permitted by law, Seller is not liable for indirect or consequential loss.
17.2. Liability is limited to repair, replacement or refund.
17.3. Seller is not responsible for mechanical damage caused by improper installation or incorrect vehicle specifications.
18. Marketing & Advertising
18.1. Promotional images are illustrative only.
18.2. Advertised savings may vary by product.
18.3. Weekly finance examples are indicative and subject to approval.
18.4. Seller complies with the Australian Spam Act 2003 for email/SMS marketing.
18.5. Customers may unsubscribe at any time.
19. Finance
19.1. Finance is subject to lender approval.
19.2. Seller does not guarantee finance approval.
19.3. Payment plans are governed by third-party provider terms.
20. Intellectual Property
20.1. All website content, branding, logos and images are the property of Ozzy Tyres.
20.2. Reproduction without written consent is prohibited.
21. Governing Law
21.1. These Terms are governed by the laws of Australia.
21.2. Disputes are subject to Australian courts.
22. Goods Left on Premises (Customer Property)
22.1. Ozzy Tyres does not encourage or promote customers leaving removed wheels, tyres, suspension components or any other personal property on its premises after installation services are completed.
22.2. As a standard practice, removed goods are wrapped and returned to the customer at the time of collection wherever possible.
22.3. If a customer elects to leave goods on the premises, this is done at the customer's request and entirely at their own risk.
22.4. Ozzy Tyres will store such goods for a maximum period of seven (7) calendar days from the date of vehicle collection, unless otherwise agreed in writing.
22.5. During this seven (7) day period, reasonable care will be taken; however, Ozzy Tyres accepts no responsibility for:
